Although Robaina & Palomino attorneys are skilled at litigating our clients' divorce cases in court-and we have been very successful doing so-we believe there are better ways to solve problems, such as collaborative law or mediation. This is especially true in divorces where the actions of angry spouses only tend to create prolonged court battles and threaten the emotional well-being of their children.

We favor negotiated divorce settlements because we believe that when there are battles, someone always loses.

In our experience, mutual agreement is generally achievable unless one side wants to punish the other. In these cases, our local opponents know from experience that we are willing and able to go to court to advocate tenaciously for our clients.

Mediation over Litigation

  • Divorce mediation involves an attorney who is a neutral party in a divorce case work toward a negotiated, out-of-court settlement of the most important and potentially contentious issues: child custody and child support, asset division, and alimony. 
  • Mediation is not binding if the parties do not reach a settlement. A mediation agreement, however, is binding and can be used in divorce court.
  • The alternative, divorce litigation, is always possible but usually more costly in terms of money, time and stress.
